Condemnation proceeding. Milwaukee County Expressway Commission, the defendant herein, acquired premises of the plaintiffs
by right of eminent domain on September 2, 1959, making two awards of damages, one in the amount of $40,400 for the taking
of certain real estate owned by the plaintiffs, and another of $1,000 for all access rights to that part of the premises which
were not taken. Plaintiffs appealed to a county Judge of Milwaukee county, in accordance with the statute, and said Judge
fixed the amount of damages suffered by the plaintiffs at $59,500. The defendant appealed from said award of damages to the
circuit court for Milwaukee county. Trial was there had to the court and a jury, and the jury found the fair market value
of the land taken on September 2, 1959, to be $49,000. Plaintiffs made several motions after verdict, including a motion for a new trial because of errors committed during the
trial. The motions by the plaintiffs were denied and judgment was entered on August 26, 1960, in favor of the plaintiffs and
against the defendant for the sum of $7,600, being the amount of the verdict of the jury less the sum of $41,400 previously
paid by the defendant, plus interest upon said sum of $7,600, less the defendant's taxable costs and disbursements. The plaintiffs
appealed from said judgment.
